Symbios Orthopédie S.A., whose registered office is in Yverdon-les-Bains (Switzerland) (hereinafter referred to as “Symbios” or “Data Controller”), collects and processes the personal data of job applicants in its capacity as data controller, in accordance with the Swiss Federal Data Protection Act of 19 June 1992 (DPA), EU General Data Protection Regulation 2016/679 (GDPR) and all applicable laws on the protection of privacy (hereinafter collectively referred to as “Applicable Law”). Symbios undertakes to be transparent about how it collects and uses this data and to comply with its data protection obligations.
Symbios has appointed a data protection officer (“DPO”) who can be freely contacted for any information regarding Symbios’ processing of personal data at the following address: privacy@symbios.ch. Symbios encourages you to read this information note on the protection of personal data carefully, as it contains important information on how it is protected and on the security measures taken to ensure confidentiality and full compliance with the applicable legislation.
We hereby inform you that your data will be processed in accordance with the principles of legality, fairness, transparency, accuracy, purpose and limitation of storage, data minimisation, integrity and confidentiality. Your personal data will be processed in accordance with the provisions of the applicable legislation and with the confidentiality obligations included therein.
What information does Symbios collect?
Symbios will collect various details about you for the purposes of the recruitment process. This information may include:
– Your name, address and contact information (including email address and phone number);
– Details on your qualifications, skills and professional experience;
– Information on your current level of remuneration, including your entitlement to benefits;
– Information on your right to work in Switzerland.
Symbios may collect this information in different ways. For example, the data may be provided in application forms, curricula vitae or collected in the course of an interview.
Such data is stored in human resources archives and other computer systems (including email).
Why does Symbios process personal data?
Symbios needs to process this data to review your application.
In some cases, Symbios must process data to ensure it is meeting its legal obligations. For example, Symbios is required to check that a successful candidate is entitled to work in Switzerland before beginning employment.
Symbios has a legitimate interest in processing personal data during the recruitment process and in keeping records of this process. By processing candidate data, Symbios is able to effectively manage the recruitment process, evaluate and confirm a candidate’s suitability for a job and decide who should be offered a job. Symbios may also need to process candidate data in response to or to defend itself against legal actions.
For some positions, Symbios is obliged to search for information on criminal convictions and offences. When Symbios seeks such information, it does so because it is necessary for it to fulfil its obligations and to exercise specific employment rights.
Symbios will use your data for the recruitment process for the position for which you have applied. If your application is unsuccessful, Symbios may keep your personal data on file for two years, in case there are future job opportunities for which you may be qualified. Symbios will ask you for your consent before storing your data for this purpose and you will be free to withdraw your consent at any time.
Who has access to your data?
Your information may be reviewed by the Symbios personnel involved in the recruitment process. They include the members of the human resources and recruitment team, the investigators involved in the recruitment process, the managers working in the industry sector where a vacancy exists and any authorised employees.
Your data may be transferred outside the European Economic Area (EEA). Data is transferred on the basis of a declaration of adequacy.
How does Symbios protect your data?
Symbios takes the security of your data seriously. It is why Symbios has internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and cannot be accessed except by our employees in the performance of their duties.
How long does Symbios keep your data?
If your application is not retained, Symbios will destroy your data at the end of the recruitment process. If you authorise Symbios to retain your personal data, Symbios will retain it for two years so that it may be used for future job opportunities. At the end of this period, or if you withdraw your consent, your data will be deleted or destroyed.
If your job application is successful, the personal data collected during the recruitment process will be transferred to your personal file and kept for the duration of your employment.
What are your rights?
As a data subject, you have a number of rights, including the right to:
– access your data and obtain a copy on request;
– ask Symbios to modify incorrect or incomplete data;
– demand that Symbios delete or stop processing your data, for example if the data is no longer needed for the purpose for which it was initially collected;
– object to the processing of your data if Symbios invokes its legitimate interests as a legal reason for processing the data.

If you believe that Symbios has not respected your data protection rights, you can file a complaint with the supervisory authority.
What happens if you do not provide personal data?
You have no legal or contractual obligation to provide Symbios with data during the recruitment process. However, if you do not provide this information, Symbios may not be able to process your application.
